1. Accounts and subscriptions

a) Creating an account :  To access certain features of the Service, you must create an account. By creating an account, you warrant that you are over 18 years of age and that the information provided is accurate, complete and current. You are responsible for maintaining the confidentiality of your account and password.

b) Subscription packages :  The Service is offered under various subscription formulas, including :

• Free level :  A free level for registered users, with access limited to the number of free credits offered when the account is created.
• Paying level :  Paid access with a generation limit based on the number of credits required for each generation.

c) Payments and invoicing :  All credit purchases are managed by our third-party payment providers, including Stripe for automatic payment by credit card, Bank Of Africa for bank transfer, MVola and Orange Money for payment by mobile money. By providing your payment information, you represent and warrant that it is accurate and that you are authorized to use the payment method. Recharges of new credits are billed on a non-recurring basis. Your subscription will always be effective, and you can view your remaining credit balance at any time from your «My Account» dashboard.

2. Using the service

a) User license :  We grant you a limited, non-exclusive, non-transferable and revocable license to use Stardust AI for personal or commercial purposes, in accordance with the limits and features of your credit balance.

b) Prohibited activities :  You agree not to use the Service to:

• Generate illegal, harmful, defamatory, obscene or hateful content.
• Generate content that infringes the intellectual property rights of others.
• Use automated scripts, bots or any other means to access the Service in a manner that imposes an unreasonable load on our servers.
• Do not share your account details with others or resell access to your subscription.

Failure to comply with these conditions may result in immediate termination of your account.

3. AI-generated content

a) Property :  You own the rights to the final results you generate using the Service («Generated Content»).

b) Accuracy and originality :  The Service uses artificial intelligence to generate content. While we strive to produce creative, high-quality content, we do not guarantee the accuracy, originality or relevance of the content generated. AI may produce content that is inaccurate or similar to existing works. It is your responsibility to verify and validate the content generated for its intended use.

c) Exclusion of liability :  We accept no responsibility for any damage or loss, direct or indirect, resulting from your use of the Generated Content. You agree to use the Generated Content at your own risk and are solely responsible for the consequences of its use, including copyright infringement if the result is too similar to an existing work.

4. Intellectual property

The Service, its functionality and features remain the exclusive property of Stardust AI. This includes the logo, user interface design and all associated software.

5. Termination

We may terminate or suspend your account and deny you access to the Service immediately, without notice or liability, at our sole discretion, for any reason and without limitation, including, but not limited to, breach of the Terms.

If you wish to cancel your account, you can do so by cancelling your subscription from your «My account» page.

6. Limitation of liability

In no event shall Stardust, nor any of its directors, employees, partners or agents, be liable for any indirect, incidental, special, consequential or punitive damages, including, without limitation, loss of profits, data, use, goodwill or other intangible losses, arising out of your access to, use of or inability to access or use the Service.

7. Disclaimer for «as is» and «as available» products»

The Service is provided «AS IS» and «AS AVAILABLE». It is provided without warranty of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, non-infringement and fitness for a particular purpose.

8. Applicable law

These terms and conditions shall be governed by and construed in accordance with the laws of the jurisdiction in which Stardust AI operates, without regard to its conflict of law provisions.

9. Changes to the terms and conditions

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. In the event of a material change, we will notify you at least 30 days before the new terms come into effect. The material nature of any change will be determined at our sole discretion.

By continuing to access or use our Service after the changes become effective, you agree to be bound by the revised terms.
